Longmont Public Media Policies & Procedures

INTRODUCTION

WELCOME

Welcome to Longmont Public Media (LPM)! Thank you for your support and involvement in creating and sustaining a vibrant media and information ecosystem in Longmont, Colorado. We look forward to welcoming you to our facility, channels, classes, events, and more. 

 

WHAT WE DO

LPM is a public access tv station and media makerspace devoted to the education, production, and distribution of local media that matters to you. We provide residents, students, and businesses/corporations access to video production training, equipment, and the ability to produce and distribute content on our public access channels and the internet. Our ~5,000sq ft media makerspace is located in downtown Longmont and is retrofitted with various studios, editing rooms, control rooms, equipment, and more to facilitate the creation of local media and content.

LPM is responsible for administering and operating the Public, Educational and

Governmental (PEG) access television station, Channel 8/880, 14, and 16, on the Comcast cable system in Longmont, Colorado.

HOW LPM IS FUNDED

LPM is an independent, 501(c)(3) non-profit organization that is publicly and privately funded and operated. LPM is not a cable company, a subsidiary of any cable company, or a City of Longmont agency. 

LPM is primarily funded by franchise fees provided to the City of Longmont, which holds franchise agreements with Comcast. The franchise agreements may be found on the City of Longmont website. We also receive funding through membership, grants, donations, sponsorships, underwriting, and production services.

MANAGEMENT

LPM is overseen and governed by a board of directors as well as through an advisory board. Day-to-day operations are handled by the Executive Director and staff. 

All decisions made by LPM’s Executive Director and staff regarding the implementation of programming policies are subject to the sole discretion of LPM and will be based on community standards.

MEMBERSHIP POLICIES

MEMBERSHIPS

LPM has a variety of different memberships at different price points. With the exception of our free community membership, these memberships are paid yearly or monthly as a recurring subscription. 

 

MONTHLY LPM MEMBERSHIP

By purchasing a Monthly LPM Membership, you agree to an initial and recurring Monthly Membership fee at the current Monthly Membership rate, and you accept responsibility for all recurring charges until you cancel or downgrade your membership. 

 

AUTOMATIC MONTHLY RENEWAL TERMS

Once you subscribe and enroll in a monthly membership, LPM will automatically process your Monthly Membership fee in the next billing cycle. LPM will continue to process your Monthly Membership fee each month at the current monthly Membership rate, until you cancel or downgrade your membership. We explain how to cancel your Monthly Membership below at the section “Membership Cancellation/Downgrade”.

 

ANNUAL LPM MEMBERSHIP

By purchasing an Annual LPM Membership, you agree to an initial and recurring Annual Membership fee at the current Annual Membership rate, and you accept responsibility for all recurring charges until you cancel or downgrade your membership.

MEMBERSHIP PERKS/BENEFITS

Each LPM membership has certain perks/benefits that are only available in the respective membership tier. Membership perks/benefits are subject to change and LPM has the right to update, modify, and/or remove membership perks/benefits as needed. 

 

MEMBERSHIP REFUNDS

LPM does not offer refunds for recurring memberships. If you wish to cancel your membership, we explain how to cancel your membership below at the section “Membership Cancellation/Downgrade”.

PROGRAMMING POLICIES

PROGRAMMING SCHEDULE

LPM will, at its discretion, provide channel time as requested on its public access channels (i.e 8/880, 14, 16) on a first-come, first-served basis. This is subject to LPM’s policies and guidelines. LPM strives to provide as much Longmont-specific content as possible and thus will give highest priority to programming schedule requests from Longmont residents and organizations. While we are committed to airing local programming and will do our best to accommodate schedule requests, LPM cannot guarantee any time slot requests as the programming schedule is ultimately determined at the discretion of LPM’s Content Manager and Executive Director. Content shown on LPM public access cable channels and online distribution platforms do not necessarily reflect the views of LPM, its staff, board of directors, or other organizations affiliated with LPM.

Adult, Violent, Hate Speech, and Graphic Programming

All programs in this category submitted for distribution by LPM are subject to the discretion of LPM.

Programs containing mature themes, mild profanity, or lifelike imagery of nudity for the purposes of artistic, literary, political, or scientific discourse may be scheduled at the discretion of LPM between 10:00pm and 4:00am on its cable channels. Programs containing depictions or simulations of sexual intercourse may be scheduled after 11:00 pm and 4:00am. Programs that contain hate speech, excessive vulgar language, nudity, extreme physical violence, extreme degradation, graphic depiction of invasive medical procedures or indecent material must include a disclaimer advising viewer discretion and may be scheduled between the hours of 11:00 pm and 4:00 am.

LPM may decline to distribute content in this category on any platform at its sole discretion for any reason or no reason at all without explanation.

The disclaimer must clearly state: 

“The following program contains material that some viewers may find objectionable or inappropriate for viewing, particularly by children. The community producer, [INSERT YOUR NAME], who submitted this program for broadcast is solely responsible for its content. The views, opinions and content of this program do not necessarily reflect the views or opinions of Longmont Public Media, its staff, or its board of directors. For more information about this program or Longmont Public Media content policies, please visit our website. Additionally, please contact the community producer at [INSERT YOUR CONTACT INFORMATION].”

The disclaimer must be read aloud and displayed on screen in easily readable text for a minimum of 20 seconds. Responsibility for including the viewer advisory rests with the program's producer/sponsor.

Additionally, LPM will require the community producer/sponsor sign a document stating that they indemnify LPM, it’s employees, and it’s Board of Directors from any and all potential legal liability.

This type of programming is subject to approval or denial for local broadcast by the LPM Executive Director or Board, based on community standards. The producer is responsible for all content and must mark the Content Submission Form in the appropriate area if their program contains Restricted Content.

Opinion-focused Programming

LPM will broadcast opinion-focused programming on its channels. Content submissions must include the following disclaimer before the programming airs on PEG channels:

“Longmont Public Media accepts content submissions for broadcast from residents, community members, business leaders, and public officials on all topics. The views, opinions, and content of this program, submitted by [INSERT YOUR NAME], does not necessarily reflect the views or opinions of Longmont Public Media, its staff, and board of directors. You can contact the community producer who submitted the following content at [INSERT YOUR CONTACT INFORMATION]."

In addition, should a content submission request that the content be uploaded to LPM’s social media and/or its OTT apps, it is the responsibility of the content producer to include the disclaimer in the submitted description. Failure to do so may be grounds for LPM to decline to broadcast or share the content on any platform at its sole discretion, and/or ban the content producer from distributing content via Longmont Public Media.

Illegal Content

LPM does not knowingly broadcast and/or livestream illegal content. Illegal content is any content that is not protected by the First Amendment of the Constitution of the United States. Unprotected content may include (but may not be limited to) slander, sedition, copyright infringement and obscenity, as defined by applicable laws. LPM reserves the right to refuse to broadcast and/or livestream any program that it determines through any means or its sole judgement may contain obscene or otherwise unprotected content.

LPM will not knowingly broadcast and/or livestream “indecent” speech (as defined by the State of Colorado in C.R.S. 18-7-101) unless safe harbor time restrictions,

parental advisories, and/or other methods adequate to protect such programming from being viewed by minors are applied.

LPM expects its users and viewers to be aware of applicable laws and also be aware that producers are legally responsible for the content of their own programming. LPM strongly suggests that producers who think their programming might contain illegal content consult with legal counsel before submitting their programs for playout.

LIVE PROGRAMMING

LPM provides community producers and organizations with the ability to produce live programming or broadcast live programming from a remote location. Community producers and organizations must first verify with LPM that the time slot is available to perform a live broadcast from LPM studios or remotely. LPM will work with community producers and organizations and instruct them on how to produce live programming. 

LPM is not responsible if the live broadcast experiences any technical or other difficulties during the production. 

Solicitation of Funds Programming

LPM may grant permission to broadcast content that is used for the solicitation of funds on its public access channels. Permission is granted on a case-by-case basis and requires community producers and organizations to submit a request in writing to the Executive Director, its staff, and board of directors. Permission is granted at the discretion of the Executive Director, its staff, and board of directors.

Commercial Content

Commercial content is not allowed on channel 8, 14, and 16. If you are unsure whether your program contains commercial content, please ask us. 

Re-airing Programming 

LPM re-broadcasts content from community producers and organizations, unless instructed not to. LPM reserves the right to reschedule the content according to its programming policies and schedule.

Program Credits for Sponsors/Underwriters

Submitted content for broadcasting may acknowledge and contain credits and sponsorship/underwriter placements. Sponsorship/underwriter placements must conform to 501(c)(3) sponsorship guidelines. For questions, please contact the Executive Director at Longmont Public Media.

Content Rights and Responsibilities

LPM produced programming is licensed under Creative Commons 4.0. Creative Commons “is a nonprofit corporation dedicated to making it easier for people to share and build upon the work of others, consistent with the rules of copyright. We provide free licenses and other legal tools to mark creative work with the freedom the creator wants it to carry, so others can share, remix, use commercially, or any combination thereof.” For more information, please visit www.creativecommons.org.

LPM strongly encourages all producers to license their work created at LPM and/or using LPM’s equipment, to be licensed under Creative Commons 4.0. Under Creative commons 4.0: 

You are free to:

Share — copy and redistribute the material in any medium or format

Adapt — remix, transform, and build upon the material

for any purpose, even commercially.

Under the following terms:

Attribution — You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.

However, producers can copyright their content. Producers will need to notify LPM that their content is copyrighted and provide LPM permission to broadcast/live stream their content. Content created/produced by community producers remains the property of the copyright owner/community producer. Click here to view the form. If content is produced at LPM studios, LPM highly encourages its producers to provide a credit to LPM following your content that reads “Produced through Longmont Public Media in Longmont, CO”.

SUBMITTING MEDIA/CONTENT

Submission Guidelines

LPM welcomes content submissions from the public to be broadcast on our PEG channels. All content submissions must be made electronically via our website and the digital files must be uploaded to LPM. Our technical requirements are listed on the submission form or down below.

LPM is not responsible if the show/movie/program does not air as scheduled for any reason.

Technical Requirements

Please use the following video rendering settings:

  • Format: .mp4 (h.264)
  • Resolution: 1920x1080
  • Frame Rate: 29.97 fps

Please only upload HD content and please provide yourself ample time to upload content. The format above is required to have your content broadcast on LPM. Failure to provide the content in the required format may result in not airing your content on LPM. If you need us to re-encode the video, please contact us.

YouTube and Video-on-Demand/OTT

Content submissions may be uploaded to LPM’s YouTube channel and our Video-on-Demand / OTT apps upon selection by the content submitter. LPM will utilize the video title, description, thumbnail, and category provided by the submitter when uploading the content submission to the designated platform. Content submissions are subject to LPM’s content guidelines and submissions are not guaranteed to be distributed through LPM’s YouTube channel and/or our Video-on-Demand / OTT apps.

MAKERSPACE / FACILITY USAGE

Studio/Space and Computer Reservations

LPM has a variety of different studios/spaces and computers available for use. While LPM is open to the general public during business hours, LPM strongly recommends that the public and its members reserve the studio/space via our member and reservation system/portal. Walk-ins can be accommodated with the assumption that the studio/space or equipment is not currently occupied. Reservations always have priority over walk-ins and all reservations have a 15 minute grace period before being forfeited by the reserver. Same-day reservations can also be accommodated if the studio/space or equipment is not currently in use.

CANCELING RESERVATIONS

Cancellations for studio/space usage must be done online, via our reservation system/portal. Since we are open to the public, if you know you cannot make a reservation for any reason, please cancel your reservation 24 hours before your scheduled reservation so that the space may be used by someone else.

STUDIO/SPACE USAGE

Studios and spaces at LPM are available for use by members, guests, and the general public. Setup, supervision of guests (if any), and cleanup of the studio / space is the responsibility of the studio / space reservation holder and must take place during the studio reservation time. Please plan accordingly and leave the studio/space in clean and orderly condition at the end of your reservation. Please be aware that other users and members and possibly their guests are entering and using LPM’s facility and studios “as is” and that you and your guests and crew do so at your own risk.

Personal Storage

Depending on the item(s), LPM may agree to let you leave certain personal items or equipment at the facility. LPM is not responsible for lost, stolen, or damaged items. 

Children/Youth

Parental supervision is required for young adults/youth under the age of 16. Please do not just drop off your kids at LPM. We are not babysitters. 

Computer Usage

LPM provides several computers to be used for editing, video switching, and more. If you decide to login using your personal account to any of our machines, please make sure you log off to prevent unauthorized access by others. Accessing materials that are obscene, pornographic, or otherwise sexually explicit is prohibited on any Longmont Public Media computers.

Studio Equipment

Users and LPM Members are responsible for all LPM equipment during their use or use of their guests. Users and LPM Members are responsible for the conduct of their guests. Guests and members must follow LPM policies and guidelines, including LPM’s Code of Conduct and Community Standards. 

LPM provides a limited amount of props and set pieces on a first-come, first-served basis. Props cannot be reserved in advance. 

Nudity / Artistic Nudity

Nudity, including Artistic Nudity of any sort, is not allowed at Longmont Public Media.  Failure to abide by this policy will result in immediate termination of your LPM membership and banishment from the premises for life.

EQUIPMENT RENTALS

EQUIPMENT RENTAL - CHECK IN/OUT

Longmont Public Media rental equipment must be checked out (i.e. picked up) during Longmont Public Media’s hours of operation, Monday to Friday, 9:00AM to 5:00PM. All equipment must be reserved in advance, via our online rental system at longmontpublicmedia.org/equipment. 

Longmont Public Media members and non-members must test and inspect all equipment before checking it out to ensure it will be functional during the reservation period. Longmont Public Media staff will test and inspect equipment upon return. 

During the check-out period, Longmont Public Media will, alongside the member or non-member, make sure the equipment is in working condition before renting out the equipment. Any malfunctions or damage will be noted immediately. Upon check-in (i.e returning the equipment to Longmont Public Media) any equipment found to be missing or damaged upon return will be the responsibility of the renter (see below for more information).

Members and non-members need to return the equipment themselves. Longmont Public Media will not accept the return if another person returns the equipment you rented. Members with 24/7 access are able to return the equipment after hours and leave it in the equipment rental drop off location.

RESERVATION DURATION LIMITS

Members and non-members may reserve equipment and/or equipment packages for no longer than 7 days at a time. If upon return the equipment is still available and no other members and non-members are looking to rent the equipment, members and non-members may reserve the equipment for an additional reservation period.

CANCELLATIONS

If you know you are not planning on picking up the equipment you have reserved, please cancel your reservation immediately so that others may reserve it.

LATE PICK UP

If the order is not picked up by Noon on the following business day, Members or individuals will forfeit their equipment rental reservation. Paid equipment rental orders will be refunded. Reservations may be able to be picked up late if you reach out to us by calling 720-544-7758 or sending an email to staff@longmontpublicmedia.org.

LATE RETURN

Fines are assessed for all equipment returned beyond the time it is due. If you are having an emergency and cannot return the equipment, please call Longmont Public Media immediately at 720-544-7758. Longmont Public Media will consider not charging late fees should you notify us of a possible late return. Fines are billed at the daily rental rate. If the equipment is not returned after 2 weeks (14 days), Longmont Public Media will consider the equipment as lost/forfeited and Longmont Public Media will fine you the total MSRP cost of the equipment rented. Members and non-members will not be able to rent out equipment until the fines are paid in full.

ACCIDENT, MISHANDLING, NEGLECT

If equipment fails due to an accident, mishandling, or neglect, liability for the replacement rests with the person who signed for the equipment. The liability includes the cost of replacing equipment stolen while it is checked out.

ORDINARY WEAR AND TEAR

If equipment failure and/or damage is due to ordinary wear and tear, Longmont Public Media will see to it that it is repaired or taken out of inventory.

MISSING/DAMAGED EQUIPMENT

This is the official policy for members and non-members who break, lose, or otherwise damage Longmont Public Media equipment, must pay for or replace the equipment. Rental privileges will be suspended until the equipment is replaced or balance has been paid. Longmont Public Media has a limited amount of equipment and we have many community members who need to share the use of this equipment. This policy is designed with the intentions of maximizing the longevity and availability of the equipment for everyone.

UPON CHECKING IN EQUIPMENT

Upon returning the equipment, Longmont Public Media will check that all equipment is being returned and is in good working order and not damaged. Longmont Public Media will reach out to you if equipment is damaged and/or needs to be replaced or repaired.

SOFTWARE AND ACCOUNT CONNECTIONS

Rentable equipment may allow renters to connect a personal software account to the device. An example of this is renting a Mevo Camera +iPad bundle to use for livestreaming an event to a Facebook Page. It is the responsibility of the renter to ensure the account has been logged out upon returning the equipment.

CLASSES

Class Registration

Users and Members must register for LPM classes online via our website. 

Cancellation of Classes

Classes may be canceled if: a class fails to meet the minimum enrollment requirement, the class instructor cancels for any reason, or due to inclement weather. LPM will make every effort to notify class participants of the cancellation. In the instances when LPM must cancel a paid class, participants will be offered the opportunity to enroll in another session of the same class or offered a refund. 

Refunds for Classes

Refunds are only available when a class is canceled by LPM or an instructor. Participants are able to cancel 24 hrs in advance of the class. To cancel, please contact Longmont Public Media. Participants will not receive a refund when a no-show occurs for a paid class.

Class Conduct

Participants of LPM classes are expected to behave in a professional manner. Please respect all fellow students, instructors and administrators. All LPM class participants must follow our Code of Conduct and Community Standards.

PRIVACY

Security Cameras

LPM has several security/monitoring cameras throughout the facility that are streaming and recording 24/7 to ensure the safety of users, members, staff, and visitors, as well as the facility and equipment therein.  

CODE OF CONDUCT AND COMMUNITY STANDARDS

LPM Code of Conduct

LPM staff is responsible for the safe and proper use of the LPM facility and equipment. All facility users and guests use LPM and services at your own risk. LPM is a media production facility and all users are expected to use caution. As such, directions and instructions from staff are to be followed at all times by all LPM facility users and guests. Failure to take direction from LPM staff may result in immediate expulsion and/or future restriction of access to the LPM facility or services.

As a LPM user, you agree to the each item on the following list of responsibilities:

  • Take full responsibility for the content of any programming that you distribute on cable channels
  • Take full responsibility for your production, including the behavior of your crew and guests
  • Comply with these Policies and Procedures
  • Treat LPM equipment, it’s facility, and studios with respect and care, both inside and outside of LPM
  • Respect the rights of others to use LPM resources
  • Make and cancel reservations in a timely manner
  • Treat LPM staff with courtesy and respect
  • Maintain up-to-date contact information in the event LPM needs to contact you
  • Eating and drinking is permitted in LPM, but please clean up after yourself when finished
  • Community producers may not identify themselves as employees of LPM
  • Pets and service animals are allowed at the LPM facility as long as they are under the supervision of its owner

The following behavior is not allowed at LPM:

  • Smoking tobacco, marijuana or other substances by any method is not allowed at LPM;
  • Entering the facilities without a shirt or shoes;
  • Making false or misleading statements on documents or to staff;
  • Possessing, using, or dispensing any illegal substance;
  • Possession of any weapon, explosive, or other dangerous material;
  • Conduct, intentional or unintentional, that could or does result in physical injury to others and/or destruction of property;
  • Theft or attempted theft of personal belonging, supplies or equipment;
  • Entering or attempting to enter locked offices, areas, or records, and/or unauthorized use of any office, computers, or other equipment;
  • Physical violence, or the threat of physical violence;
  • Rude, discourteous or raucous behavior such as screaming or cursing that is directed at LPM community or staff members;
  • Activities or conduct which disrupt the activities or operations of LPM or the ability of others to conduct business;
  • Derogatory language about an individual, group, user, member, LPM staff (as determined by LPM’s sole discretion);
  • Harassment, including sexual harassment, of any employee, user or guest.
  • Nudity of any kind, including artistic nudity.
  • Activities that may result in unsafe or unsanitary conditions;
  • Personal attacks on community members, LPM staff members and/or LPM guests;
  • Intentional misuse, intentional damage to, or intentional loss of LPM property;
  • Removal of LPM property from the premises without authorization;
  • Misuse of LPM electronic information systems;
  • Inciting divisiveness among LPM Staff, members, and/or guests;
  • Any other inappropriate behavior as determined by LPM at its sole discretion.
  • Sleeping at LPM
  • Disruptive behavior while under the influence of drugs or alcohol

Failure to comply with any of the above identified responsibilities and behavior, or any other responsibility identified in these Policies and Procedures may result in sanctions, termination of membership or other actions permitted by law.

Community Standards

LPM welcomes discussion, interaction, and engagement on our digital platforms and at our facility. We ask all who want to join and participate keep the following in mind:

  • We do not tolerate racism, sexism, homophobia, and hate speech as well as interactions that can be interpreted as such
  • We do not tolerate personal attacks on users, members, LPM staff, and community members
  • We will remove any content that may violate LPM policies or put LPM in legal jeopardy

Any time LPM makes a decision on whether or not to distribute content, it will take into account community standards. LPM reserves the sole right to determine what it is in line with community standards but may at its sole discretion include any factors including but not limited to the general expectations of its audience regarding the type of content which LPM makes available to the community.

Disciplinary Action & Appeals at LPM

Failure to comply with LPM’s policies included in this document and on any LPM agreement(s) may result in disciplinary action up to the suspension and/or withdrawal  from LPM. LPM may also suspend and/or terminate your membership, suspend you from LPM for a period of time, or permanently ban you from LPM. 

Individuals who wish to appeal disciplinary decisions resulting from violations of LPM’s policies may submit an appeal to the Executive Director of Longmont Public Media where the issue arose within 30 days of the decision. Any restrictions will remain in effect pending the outcome of an appeal. The Executive Director will aim to respond in 60 days. The Executive Director's decision is final.

Waiver of Liability

General Waiver

Member acknowledges that he/she is using the facilities at his/her own free will and decision. Member acknowledges that Longmont Public Media does not have any liability with respect to Member’s access, participation in, use of the facilities, or any loss resulting from such participation or use. Longmont Public Media and its respective board members, employees, volunteers, instructors, agents, contractors and officers shall not, to the extent permitted by law, be liable for, and the Member waives all right of recovery against Longmont Public Media and such individuals for any damage or claim with respect to any injury to person or damage to, or loss or destruction of, any property of Member, it’s contractors, employees and invitees due to any act, omission or occurrence in or about Longmont Public Media or the Building. Except for gross or willful misconduct by Longmont Public Media, Member agrees to indemnify, defend, protect and hold Longmont Public Media and its respective board members, employees, volunteers, instructors, agents, contractors and officers harmless from and against all claims of whatever nature arising out of Member’s use of the facilities and occupancy of Longmont Public Media. Members are strongly encouraged to carry insurance that covers their personal equipment while using the workspace at Longmont Public Media.

Provision of Resources

Member acknowledges that due to the imperfect nature of electronic communications, electronics and utilities, Longmont Public Media shall not be responsible for damages, direct or consequential, which may result from the failure of Longmont Public Media to furnish any of the Services. Longmont Public Media will, however, act in good faith and in a commercially reasonable manner in working to remedy any flaws in the facilities or equipment, or delays in providing access to the facilities or equipment to the Member.

Acknowledgement of Risk

You agree that you are voluntarily joining or visiting Longmont Public Media, or participating in a Longmont Public Media activity with knowledge of the risks of doing so, such as the risks of injury, property damage, or death resulting from the use of potentially dangerous tools or materials, even if these risks or hazards are unknown to you, and/or the active or passive negligence of Longmont Public Media, A Colorado Nonprofit Corporation and its respective officers, directors, employees, and agents (collectively, “we” or “us”). You release us from all liability, claims, damage, or demands arising from or related in any way to being a member or guest of Longmont Public Media or your participation in any Longmont Public Media activity.

Use of Media

You hereby authorize Longmont Public Media to: (a) Record my likeness and voice on a video, audio, photographic, digital, electronic or any other medium. (b) Use my name in connection with these recordings. (c) Use, reproduce, exhibit or distribute in any medium (e.g. print publications, video tapes, CD-ROM, Internet/WWW) these recordings for any purpose that Longmont Public Media, and those acting pursuant to its authority, deem appropriate, including promotional or advertising efforts.

You release Longmont Public Media and those acting pursuant to its authority from liability for any violation of any personal or proprietary right you may have in connection with such use. You understand that all such recordings, in whatever medium, shall remain the property of Longmont Public Media
